Treasury Investigates Consumer Guarantees

The Department of Treasury has released a consultation document on consumer guarantees and supplier indemnification under the Australian Consumer Law.

This follows on from the previous consultation in December 2021 broadly covering the same topics, including:

  • How long should a vehicle be classified as a new vehicle?
  • What types of vehicles should be captured under the definition of a motor vehicle?
  • Should depreciation factors be included in determining refund amounts?
  • What is the appropriate relationship between manufacturers and suppliers?

As was the case with the previous consultation, HVIA believes most of the problems for consumers are with the light vehicle industry rather than the heavy vehicle industry.

However, it recommends that manufacturers and dealers should read the consultation document and consider providing their own submission to the Department. Submissions close on November 14, 2024.
